Op 1 december organiseert het Centre de Recherches Informatiqueet Droit in Brussel een workshop rond cross-border rechtenmanagement bij online music services.
Cross-border management of copyright in the field of legal digital music services has encountered significant changes over the recent years. Actions of the European Commission have allowed to overcome the system traditionally put in place by collecting societies, namely the provision of territorially limited licences for the on-line exploitation of music. By doing so, the Commission indicated its preference for introducing competition among collecting societies and to a large extent leave the market to self-regulate. As a result of the Commission's actions, large right-holders appointed specific agents to grant pan-European licenses. Such market developments have been welcomed by some, criticised by others.
What is the situation today? Has the Commission achieved to introduce 'multi-territorial licensing in order to enhance greater legal certainty to commercial users in relation to their activity and to foster the development of legitimate online services, increasing, in turn, the revenue stream for right-holders' (2005 Recommendation on collective cross-border management of copyright and related rights for legitimate online music service, para.8)? The question will be raised to a panel of representatives of EU institutions, academics and stakeholders
